You represent that you are at least 18 years old and have the authority to accept these Terms on behalf of yourself or any entity you represent.

We provide digital and affiliate marketing services. Specific scopes, deliverables, pricing, and timelines are defined in separate proposals or agreements (“Service Agreements”).
3) No Guaranteed Outcomes
Marketing performance can vary due to external factors. We do not guarantee specific results, conversions, or profits unless explicitly stated in a Service Agreement.
4) Acceptable Use
- Do not use the Site or services for unlawful, harmful, or fraudulent activities.
- Do not interfere with Site security, attempt to access non‑public systems, or reverse engineer software.
- Comply with applicable advertising policies, platform rules, and local regulations.
5) Fees & Payment
Unless otherwise agreed, invoices are due as stated in the applicable Service Agreement. Late payments may incur charges permitted by law or contract.

All Site content, trademarks, and materials are owned by Kafinity or its licensors. Deliverables created under Service Agreements will be licensed or assigned as specified in those agreements.

Each party may access confidential information of the other. Both parties agree to protect such information and use it only for the purposes of the engagement.

Campaigns may involve third‑party platforms or networks. Their terms and policies apply independently. We are not responsible for third‑party service outages or policy changes.
9) Disclaimers
The Site and services are provided “as is” and “as available” without warranties of any kind, express or implied, to the maximum extent permitted by law.
10) Limitation of Liability
To the fullest extent permitted by law, Kafinity shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability is limited to fees paid to us for the services giving rise to the claim.
11) Indemnification
You agree to indemnify and hold Kafinity harmless from claims arising from your use of the Site or breach of these Terms.
12) Termination
We may suspend or terminate access to the Site at any time. Service Agreement termination will be governed by the relevant contract.
13) Governing Law & Dispute Resolution
Unless otherwise agreed in a Service Agreement, these Terms are governed by the laws of Hong Kong SAR, excluding conflict‑of‑law rules. Disputes will be resolved by good‑faith negotiation, and if unresolved, by courts located in Hong Kong SAR.
14) Changes to Terms
We may update these Terms from time to time. Continued use of the Site after changes indicates acceptance of the updated Terms.
